THERE IS MUCH DEBATE OVER WHAT KINDS OF FOOD GOODS TO STOCKPILE, HOW MUCH IS ENOUGH, WHERE TO GET IT, WHERE TO STORE IT, HOW TO STORE IT, AND HOW MUCH IS IT GOING TO COST ME TO NAME BUT A FEW.  WHAT I AM ABOUT TO TELL YOU IS JUST ONE SUGGESTION, WHICH TENDS TO BE THE CHEAPEST I HAVE COME ACROSS SO FAR.  MY PLAN ALLOWS ME TO STORE A ROUGH MONTH'S SUPPLY OF FOOD FOR ONE PERSON IN A 5 GALLON BUCKET.  THE BUCKET ALLOWS FOR EASY STACKING, AND TRANSPORTATION.  ESPECIALLY WHEN HAVING TO QUICKLY MOVE YOUR FOOD STORES VERSUS HAVING TO MOVE INDIVIDUAL CANS AS TIME IS USUALLY OF THE ESSENCE.  IN AN EMERGENCY, EVERYONE CAN GRAB A BUCKET BY IT'S HANDLE AND RUN OFF WITH A MONTH'S SUPPLY OF FOOD IN THEIR HANDS.   ANOTHER BENEFIT OF USING A BUCKET, WHEN IT IS EMPTY, IT CAN BE USED TO CARRY OTHER ITEMS, TO TRANSPORT WATER FROM A WATER SOURCE OR PUNCH A SERIES OF HOLES IN THE BOTTOM AND TURN IT INTO A WATER FILTER WITH SAND, CHARCOAL AND A CLOTH, 

  MOST PEOPLE TEND TO STOCKPILE WHAT THEY ARE ACCUSTOMED TO EATING AND WISH TO CONTINUE EATING AS IF ALL IS NORMAL EVEN DURING THE HEIGHT OF A DISASTER.  IN THIS MIND-SET THE PURPOSE OF STOCKPILING FOOD IS PARTIALLY LOST.  YOUR STORES OF FOOD ARE MEANT TO AUGMENT YOUR ABILITY TO SCAVENGE, FORAGE AND HUNT FOR FOOD.  THE ONLY EXCEPTIONS ARE THOSE SITUATIONS WHERE LEAVING A SECURE AREA TO FIND FOOD IS COUNTER PRODUCTIVE TO YOUR PARTICULAR SURVIVAL SITUATION.

ITEMS AND COSTS:

1) FIRST YOU WILL NEED AN AIRTIGHT CONTAINER.  GO TO HOME DEPOT AND PICK UP A HOMER BUCKET AND LID.  ONCE THE LID IS PRESSED ON, IT IS SEALED TIGHT REQUIRING YOU TO TEAR A PULL TAB THAT ENCIRCLES THE LID TO UNLOCK IT.  THE ORANGE HOMER BUCKET W/LID COSTS LESS THEN $5.  DO NOT SEAL IT UNTIL YOU HAVE PLACED YOUR FOOD STORES INSIDE.

2) NEXT IS YOUR GRAIN, YOU WILL NEED 25 POUNDS OR 12.5 KILOS OF RICE, WHAT KIND IS CONSUMER PREFERENCE AND BASED ON AVAILABILITY.  TYPICALLY, WHITE RICE IS THE CHEAPEST AND MOST READILY AVAILABLE.  YOU CAN BUY 25 LBS BAGS OF RICE AT SOME WALMART STORES, COSTCO, AND EVEN 50 LBS BAGS AT SOME SAM'S CLUBS FOR PRETTY CHEAP.  I GOT A 50 LBS BAG AT SAM'S FOR $17.  ONE OF THE GREAT THINGS ABOUT RICE IS THAT THEY KEEP FOR VERY LONG PERIODS OF TIME AS LONG AS THEY ARE NOT EXPOSED TO WATER.  EVEN RICE THAT HAS TURNED YELLOW FROM EXPOSURE TO MOISTURE AND SPOILAGE IS EDIBLE.  THE VIET-CONG DURING THE VIETNAM WAR SURVIVED OFF OF IT FOR YEARS.

3) NEXT IS YOUR LEGUME, YOU WILL NEED 5 LBS OF BEANS, PREFERABLY DRIED. EITHER PINTO, NORTHERN, NAVY, BLACK OR KIDNEY.  ONCE AGAIN, CONSUMER'S PREFERENCE.  USUALLY YOU CAN GET 1 LBS BAGS FOR LESS THEN A DOLLAR EACH OR BUY THE CHEAP 20 LBS BAGS OF PINTO BEANS AND SEPARATE INTO 5 LBS ZIP-LOCK BAGS.

4) NEXT, FOR SOME VARIETY AND COOKING FLEXIBILITY, IS ANOTHER GRAIN.  BUY A LARGE BAG OF FLOUR, WHEAT OR BLEACHED, YOUR CHOICE.  YOU CAN GET 25 LBS BAGS FOR CHEAP AT WALMART, SAM'S AND COSTCO'S. SEPARATE IT INTO 3 POUND BAGS. JUST ADD SOME WATER, A PINCH OF SALT, A COUPLE PINCHES OF SUGAR, CLUMP IT AROUND A STICK AND PLACE OVER AN OPEN FLAME, A SIMPLE BREAD, OR FLATTEN AND PLACE ON A METALLIC SURFACE OVER A FLAME, A SIMPLE FLAT BREAD.

5) NEXT, YOU WILL NEED A 2 LBS BAG OF DRIED POTATO FLAKES WHICH IS A GOOD STARCHY TUBER. THESE USUALLY ONLY COST A COUPLE OF DOLLARS $2-$3 AT WALMART OR AROUND $5.50 AT SAM'S FOR (2)X 2 LBS BAGS.

6) NEXT, GET A ZIP-LOCK BAG AND PUT IN A CUP OF SALT. YOUR BODY NEEDS SALT, A PINCH OF SALT IN YOUR FOOD A DAY HELPS REGULATE YOUR BODY FUNCTIONS, CAN DRAMATICALLY CHANGE THE FLAVOR AND IS CRITICAL DURING HOT WEATHER ENVIRONMENTS WHERE SWEATING IS LIKELY.  ALSO HELPS WITH THE TASTE IF THE RICE BECOMES STALE.

8) LASTLY, YOU WILL NEED A HAND WARMER.  YOU CAN GET THEM FOR ABOUT A $1 FOR 2 OR YOU CAN GET 20 FOR ABOUT $6.50 AT HOME DEPOT IN THEIR 10 PAIR PACKS. HAND WARMERS CHEMICALLY REACT WITH OXYGEN TO PRODUCE HEAT, BY PLACING THEM INSIDE YOUR FOOD BUCKETS, THEY CONSUME THE OXYGEN AND WILL HELP PRESERVE YOUR FOOD STORES.

FIRST, WIPE OUT THE INSIDE OF THE BUCKET AND LID WITH A CLEAN RAG. PUT IN 25 LBS OF RICE SEPARATING IT FROM THE WALL OF THE BUCKET AS IT ISN'T FOOD GRADE AND THERE IS THE POSSIBILITY OF CHEMICALS LEECHING FROM THE PLASTIC INTO THE FOOD THOUGH THIS IS USUALLY WITH LIQUIDS OR ACIDIC FOODS.  ESPECIALLY WHEN THE PLASTIC OF THE BUCKET IS HEATED FOR PROLONGED PERIODS OF TIME OR IF THE FOOD IS HOT.  FOR THAT REASON, STORE THE BUCKETS INSIDE THE HOUSE WHERE THE TEMP CAN BE REGULATED AND NOT IN THE SHED OR AN UN-AIR CONDITIONED GARAGE.  A SIMPLE AND CHEAP LINER TO SEPARATE THE RICE FROM THE BUCKET IS SARAN OR CLING WRAP BUT ENSURE THAT IT IS NOT OVER THE BUCKET LID WHEN YOU PLACE ON THE LID AS THIS CAN ALLOW AIR IN, YOU DON'T NEED TO SPEND MONEY ON MYLAR.  MYLAR BLOCKS UV LIGHT AND ISN'T REACTIVE TO FOODS, BUT WITH THE FOOD BEING INSIDE THE BUCKET AND INDOORS THE THREAT OF UV LIGHT DEGRADING THE FOOD IS NEGATED AND THE FOOD BEING DRY RICE NEGATES ANY POTENTIAL FOR A REACTION.  LEVEL IT, THEN PACK IN THE REST IN THEIR SEPARATE BAGS IN THE SPACE AVAILABLE EXCEPT FOR THE HAND WARMER. Pics from my trip to Wasteland Weekend

I went to WW this year, got some pics with my camera till I lost the batteries and the thing that holds them in. I took some with my camera phone but they aren't great and I don't know if I'll be able to put them up. While I was there I noticed it is not about Mad Max all that much from the pics I saw of previous ones. I was sick most of the time so I just lay in my hobo tent. At the end there was people taking video for Wasteland 2, I almost participated in the run to. I'll try to put more of my pics up as well as get some from the people I went with till then these pics are what I have.

Rebirth

Rebirth was a interesting book to say the least. It attempts to blend religions for the purpose of the book and at first it doesn't seem to do it. As time goes on though it begins to feel a lot more fluid. I quite enjoyed the book as it builds upon the previous book and makes it so you want to read the next. If you thought the first was a little boring it's likely you may find the second a little as well, but the main story is still building up so that I think is ok. I'm sorry I didn't get this post out 2 months ago like I thought I would, but I just have kept putting it off as I tend to do. Hopefully I won't do that with the third book, till then be sure to read my other post's.

Airship's to fly the skies?

Basically this guy want's to one day have Airship's flying around the world doing toe heavy lifting. Being able to carry 500 tons of goods would be very useful, if these are around after a collapse they could be very useful for rebuilding and traveling.

Drought Hits 55% of US

55% of the US is being hit by a drought that is the among the worst this century. What does this have to do with you? Well if your in the effected area it means that you will be hit by water rations. And later on this year it will mean we will all be paying more for corn and other produce. And currently it could mean meat prices mainly beef will go up for lack of feed.

Drones, and your right to no privacy

It's the time of the drone, and quite frankly it scares the shit outta me as it should you. All you need to do is look at this video to realize these things are getting smaller and deadlier. We all know about the weaponized predator drone and the like.

And then theres talk of swarms of drones flying around watching us, and then theres the ones people can buy for $300 and use via their ipads or iphones or whatever. It's all leading to a lose of individual privacy to be sure, but it's not like most people seem to care anymore.

They Call me Crazy short story by the Blacksheep

 The following is a short story written by Blacksheep at the PAF, I thought I would see about showing it to more people. You can find his original post here.

"A few weeks ago I was bored and feeling creative. So I hashed together some stuff from old poems and weird feelings and opinions I possess. It's nowhere near finished, and it's definitely not fluid, so feel free to nail me to the cross if you feel confused. This is not a day-by-day story, by the way. Enjoy, and don't be afraid to criticize. You won't hurt my feelings.




'They Call Me Crazy', The Journal of an American Detainee



A short, tan man in dirty coveralls fiddled with a ring of keys outside of a small quonset hut. After a moment of struggling with the lock he managed to open the door. Once inside, he secured it and set a piece of rebar across two brackets on either side of the wall beyond the threshhold.

He knelt by a desk and turned on a portable radio and turned up the volume; the signal was not very clear, but it played the classic rock he appreciated. He hummed along to Buffalo Springfield's For What It's Worth and sat indian - style, taking a Zippo and a Lucky Strike cigarette from his breast pocket. He put it to his lips, ignited the coffin nail, and after replacing the lighter felt around on the floor of his cramped quarters for a spell.

With his fingertips he tugged at a floorboard. It was jarred from its place after a few seconds of jostling that had obviously been perfected after years of practice. The board was carefully lifted and placed aside to reveal a hole nearly a foot deep and two feet across. From it he took a wooden stationery kit and a battered ammunition can. The kit was placed on the desk above and the ammo can beneath it.

He opened it and removed a small book wrapped in plastic along with a pen. The book was unwrapped and placed alongside the box. The point was pressed to the first page.


15 April 2030

My name is Stanley Shawe Kelly. I was born in San Jose, California on April 15th of 2002. Today is my birthday. I am twenty eight years old and live in Energy Camp 'Great Basin' outside of Ely, Nevada where I am a custodian at a school. I am known as citizen 332-13-8936 (F).

My wife and three children are with Jesus. I miss them every day.

We are called bigots because we protest executive overreach.

We are called traitors because we question authority of the corrupt.

We are the enemy and the enslaved.


In 2022 President Lee Chavez was elected under a Democrat - Republican unity ticket formed as a coalition against the growing threat of a movement known only as the 'Liberals'. This political movement was outlawed and put on the federal terror watchlist shortly after the election after a nationwide investigation of members resulted in seizure of goods and arrests for purported domestic terror activities. These activies included, but were not limited to firearm ownership, stocks of a week's worth of food or more, and 'radical' reading material.

To make this possible, a committee headed by the Department of Justice and the Chavez Administration initiated an executive order called the 'Police Actions and Powers Act', or 'PAPA' for short.

PAPA put every police agency in the United States under the direct authority of the Department of Justice, which as a body of the executive branch could provide the administration with unlimited ability to exercise its will in the name of collective safety and security.

They took me away from my wife and children after I was laid off and could no longer support them. All of our tax dollars went to the undocumented folks anyways. I got placed in Great Basin and was given a job through the camp's lottery system as a janitor. Guess it didn't matter that I'd spent a few years doing IT work beforehand. That's just how it works - piss poor idea.

I do not know where my family is but I get a letter every month saying they are 'okay'. I fear only the worst.


Stanley turned to the last page of the journal. He had read what was written here before nearly every day.


One day you can write about your adventures in this book, and you can tell me about all of them.

Below the message was an old polaroid of a him as a child with his mother and father along with a two dollar bill. He closed the journal and put both hands to it. With a long, pained exhale, he carefully covered it in its plastic wrapping and placed it in his breast pocket. The stationery kit was left in its place and the ammunition can was brought up to his lap.

He pulled on the lid of the container and produced a parcel in a manila envelope. The envelope was opened and he placed the object wrapped in an oily rag on the table gently to avoid making too much noise.

The rag was carefully unwrapped to reveal a revolver; a British Webley Mk. VI that his great grandfather had brought back from the War as a gift to his son - Stanley's father."

Detroit, forgotten but not

It may seem like I'm piking on Detroit with all the post's I've linked to it lately about it's very public problems, but that's not the case. Detroit is simply getting more and more interesting because it is fast becoming a fallen giant. At one time it was a car production giant, now more than a few factories are closed down. There are so many abandoned and decaying homes there from past riots and money wows that it's just so fascinating to someone like me. Detroit is second only to Flint Michigan on the top ten most dangerous cities in the US, and crimes rates are still going up. With the city trying to save all the money it can it's laying off it's police, which in turn will lead to even higher crimes rates. I finish this off by saying so long Detroit, hope things get better.

Metro: Last Light update

Metro: Last Light is the sequel to 4a's Metro 2033. It's current release date is some time in 2013. I know that I for one am waiting patiently(well maybe not) to once again explore post apocalyptic Moscow and it's decaying metro system. Detroit: The Dying Giant

Detroit is rapidly becoming a abandoned city, and if it continues it could one day be a American Pripyat in not to long. Currently to save cash they are turning out the light in certain areas to try to get all the remaining people into one area. The city is already filled with abandoned ruins from past riots as well as failed ideas and dreams. It'll be interesting to see what happens to the city in the future. Not much to say on the subject other than that but still Detroit is basically the closest thing to a PA setting here in the US.

The Judas Syndrome

This is my first ever review on the blog so I don't yet know how I'm am gonna do everything. But what I can tell you is that I won't be rating things, I'll try to give honest reviews of how I view whatever the thing is I'm reviewing. I will try to pick apart whatever it is that I am reviewing to get out the bad and the good. That being said I hope this helps people decide whether or not

So a little while ago I was contacted by Michael Poeltl to do a review of his The Judas Syndrome Trilogy. This is the first review of the first book for which the trilogy is called, The Judas Syndrome.
 The book center's around 14 collage age men and women that survive a nuclear apocalypse and are just trying to survive, while high and drunk of course. Along the way they are constantly attacked, have to deal with death of members both caused by enemies without and within. The book use's religion as a central theme for whats underlying everything, but doesn't do it in a way that goes down hard(this is what I am getting at least so far, it could be the I am wrong I'll need to read the other books to find out). If your really against religion you may or may not like the book, but I myself was able to read it without cringing(I'm a deist so ya)so I think most people will be able to as well. While I don't want to give any of the book away I will say that I found the book to be worth the read if your looking to add to your Post Apocalyptic or "PA" genre of books.

Revolution

There is gonna be a new show on NBC "Revolution".

It looks like it will be fairly interesting, and I'm sure that some people will tune in to watch. And if it's any good we'll have to hope it doesn't go the way of Jericho(which may be coming back on Netflix by the way). If you want more info on it check this link. The show center's around all electrical devices going out, which I hope they explain with something that makes sense. One thing is though that there doesn't seem to be any modern guns, but plenty of bows and some blackpowder rifles. Kinda confusing as I don't see why no one is using modern weaponry other than maybe everyone used up all the ammo somehow and decided they couldn't make more. Still this show is interesting and I know I'll give it a go at least.

I found this posted on the PAF and thought it was pretty interesting. Basically it's Urbex or Urban Exploration(though the house isn't really urban in this) and the video itself is pretty well done. A message to Preppers

This is something I just want to get out there as I recently got a email from a tv show asking for preppers. What I want to say is this "DON'T DO IT. IF YOU DO YOUR A IDIOT, YOU JUST TOLD THE WORLD WHERE YOU ARE AND WHAT YOU HAVE. AS WELL AS MAKING THE REST OF US PREPPERS LOOK LIKE CRAZIES WORRIED ABOUT THE END OF THE WORLD HAPPENING NEXT WEEK BECAUSE OF ONE SPECIFIC EVENT." Now that I got that out I just want everyone to take a second and think about it. Vault72 is helping a group of preppers to build a fortified position that will hopefully keep them safe, and I hope them the best. But if they do get onto Doomsday Preppers they had better be prepared to deal with the consequences of that action. With these shows there was hope among the the prepping community that they would cast a positive light on preppers. They didn't, they have done everything they could to make preppers look crazy and/or obsessed with the end of the world. Most of us don't think there is only one way for a disaster to cause the collapse of the world society as we know it know. But with these shows it is made to look like that's how we all believe. Doomsday preppers forced this upon the people that do their show as talked about by Christopher Nyerges.

So please, if your really looking at doing one of these shows be aware of the danger you are putting yourself and your family in. As well what it does to other preppers.

"Economic" Bunkers from Vivos

This honestly sounds horrible to me, but same of you may feel differently. Vivos is planning to make "economical" bunkers since their other bunkers are a little...expensive. The new ones sound like they just shove everyone in a giant room and expect everyone to play nice. I say good luck with that, I'd rather build my own bunker for the price of $10,000 that they want. Especially when this "cheap" bunker is all the way in Nebraska.

A Wasteland Tip

I thought I would try something new, it's not gonna be very big but it will be something that you might not have thought about.
This is something that I read about in one of Cody Lundins books, cotton balls coated in vaseline. I have a good amount in my bugout bag right now. What you do is coat the cotton ball with the vaseline doing your best not to tear it all up as you do so. You want to coat the outside but try to keep the inside free of vaseline so that you can tear it up and catch a spark with the cotton. All the ones I have I use to help start fires because the vaseline makes it last longer, and the cotton balls are soaked to the core and all smashed up in pill bottles. But they still work really well helping me start fire's. Anyways I though I would give this quick tip as it's always good to have extra ways to help start fires. This is a Wasteland Tip by your King of the Wastes!!

Wasteland 2

I thought that I would post this, if you have played Fallout then you are playing the spiritual successor to Wasteland. And InExile has decided to make a sequel for Wasteland called you guessed it, Wasteland 2. Whats happening

So you may be wondering why there hasn't been any post's for over a week, and there IS a answer that I have for you. I just haven't gotten around to sitting here and typing anything up. But don't worry, I will hopefully get around to doing a couple articles soon. I need to put together my BoB and when I do I will be sure to show everyone what I have in it. RUIN

The Walking Dead Game

Save you pre-64 coins!!!

 Here is something you may want to look into as a trade good, pre-64 US dimes, nickels, and quarters. These coins have silver in them, and as such could be used to trade for things like food and ammo. The easiest way to get them is to just buy them, but this will be expensive with current precious metal prices. The one's I personally have are ones that I have gotten in my change. Any way you do it, this is a trade option you should look into.

The Doomsday Vault

What is it? Well it's probably not what you expect it is, unless you have heard of it before. The "Doomsday Vault" is a giant seed repository. In it are seeds from all around the world, stored incase of natural disaster, war, water shortages, or war. Check it out here for more info. The vault is underneath a frozen mountain in Norway, and stands ready for use should it ever be needed.

If your in the Midwest or South, GET THE HELL OUTTA THERE

If your following the news like I am then you know what's happening in the Midwest and south, tornado's. A F-4 hit Harrisburg, Ill at 5AM at a time when they don't happen for the most part and at a time most people were still asleep. Now that was 2 days ago, and these twisters are still going on. My suggestion to any of you that are living in the area's that are effected. That you need to either hunker down in a storm shelter or if you have family in area's that aren't being effected go see if you can spend some time with them. I hope you the best. And I want everyone else to look at what's going on and remember this saying "Hope for the best, Prepare for the worst."

Doomsday Bunkers

While this is likely just posturing by Putin to get votes out of the defense industry, this is something we need to watch. There is already a cold war going on between Saudi Arabia and Iran, we don't really need another between the US and Russia again.

No way to stop leak of virus info

 So apparently the chairman of the US National Science Advisory Board for Biosecurity says that there is no way to stop the leak of how H5N1 could be mutated to be human transmissible. Now the H5N1 is the birdflu virus, which is what the Spanish Flu was(not that exact strain mind you). This is truly terrifying if you think about it, if terrorists or rogue scientist were to get there hands on this info then they could unless a pandemic upon the world. Chilling stuff if you ask me.

The next Nuclear Arms Race

So I am sure if you have been watching the news you will have heard about Iran and it's nuclear ambitions. In the coming days Ahmadinejad while will be announcing a major achievement towards that end. What it is we can only speculate. The rising tensions in the middle east between Iran and all the other mid-east nations is growing, to the point that Saudi Arabia has announced that it will seek to buy Nuclear Weapons  should Iran test a A-Bomb. Now this comes on the heels of Iran's Supreme Leader Ayatollah Ali Khamenei announcing that it is a state sponsor of terrorism. Now this all may seem unimportant to you but it is important. Should tension build to a boiling point AFTER these nations have achieved nuclear armament then a nuclear war could ensue. This would be bad, as we all know from history a war between 2 nations that have opposing allies can spiral out of control. While it may not happen and I could be speaking out my ass I would still like everyone to take the time and money and prepare for it just in case. There is a quote by Albert Einstein about WW3, "I do not know what weapons World War III will be fought with, but World War IV will be fought with sticks and stones."

Navy to test 32 megajoule em railgun

I did a post on this a while back, talking about railgun testing in the near future. Well the Navy is getting it's first railgun soon and will begin testing them. I think this is pretty amazing, and it makes me wonder if it will ever become man portable. It also makes me wonder if it will ever be available to civilians. For more on this here's the link.

Doomsday Preppers the Series

A brand new show by NatGeo called "Doomsday Preppers". I know that I'll be watching and I hope that all of you will be as well. I am gonna be laughing my ass off the entire time more than likely, it honestly looks like they got the most outlandish preppers that they could find for the show. Don't get me wrong, I'm sure they are serious but it looks like most of them could stand to lose a couple HUNDRED pounds. I'm plump myself but I, exercise, go to the gym 4 to 5 times a week, and spend between 1 and 3 hours there. But maybe I'm jumping the gun here and judging a book by it's cover, I really do hope that the show brings more people into the prepping universe. I personally got into prepping from playing Fallout 3 and dreaming about the wastes, then realizing just how truly SHITTY life would be. This is the King of the Wastes, hoping all of you a happy tv series that hopefully will have more than 2 seasons like The Colony did....

Bethesda wins rights to make Fallout mmo

 If you have been following the spat between Bethesda and Interplay over the Fallout mmo as I have then this is big news. Bethesda has won the rights to keep both the Fallout franchise and make the Fallout mmo which Interplay was unable to begin. BETHESDA SOFTWORKS® IN INTERPLAY LITIGATION

All Fallout® Intellectual Property Rights Belong Exclusively to Bethesda

January 9, 2012 (Rockville, MD) –ZeniMax® Media Inc. today announced that a settlement had been reached in the lawsuit filed by its subsidiary, Bethesda Softworks®, against Interplay Entertainment Corporation in 2009, Bethesda Softworks LLC v Interplay Entertainment Corp., seeking cancellation of the license granted to Interplay to develop a massively multiplayer online game (MMO) based on the Fallout brand. Bethesda maintained in its complaint that Interplay had failed to meet the conditions for the license and the license was therefore of no continuing validity.
Under the terms of the settlement, the license granted to Interplay to develop the Fallout MMO is null and void, and all rights granted to Interplay to develop a Fallout MMO revert back to Bethesda, effective immediately. Interplay has no ongoing right to use the Fallout brand or any Fallout intellectual property for any game development. ZeniMax will pay Interplay $2 million as consideration in the settlement, each party will bear its own costs of the litigation, and Bethesda will continue to own all Fallout intellectual property rights. Interplay will be permitted to continue to sell the original Fallout ®Tactics, Fallout® and Fallout® 2 PC games through December 2013, after which time all rights to market those games revert to and become the sole property of Bethesda. Under the original agreement pursuant to which Bethesda had acquired the Fallout property, Interplay was granted certain merchandising rights to sell those original Fallout games, but those merchandising rights will now expire on December 31, 2013.      

The lawsuit against Interplay arose after Bethesda Softworks acquired all Fallout intellectual property rights from Interplay in April 2007, and conditionally licensed back to Interplay certain trademark rights to make a Fallout MMO, provided Interplay secured $30 million in financing for the MMO and commenced full scale development of the game by April 2009. Bethesda alleged in its complaint that Interplay failed to meet either condition of the license back agreement but refused to relinquish its license and insisted it would develop a Fallout MMO.  Bethesda filed suit to declare the license void.
In a separate but related matter, Bethesda commenced a second action against a purported developer of the Fallout MMO, Masthead Studios, Bethesda Softworks LLC v Masthead Studios Ltd. In the course of the original lawsuit against Interplay, Interplay had claimed that it had engaged Masthead Studios to develop the Fallout MMO under its license, and contended that Masthead was engaged in full scale development of that game. Bethesda filed its separate lawsuit against Masthead to assert copyright infringement and other violations of Bethesda’s intellectual property rights. Under the MMO license granted to Interplay, Interplay was not permitted to sublicense any rights granted without the prior approval of Bethesda, approval which had never been requested or granted.  In responding to Bethesda’s lawsuit, Masthead denied that it had been using any of Bethesda’s intellectual property in developing an MMO. Masthead and Bethesda settled that second lawsuit on December 29, 2011.  In the settlement, Masthead acknowledges it has no legal right to use any Fallout intellectual property, and agrees it will not use any such intellectual property of Bethesda in the future.  No payments were made by either party as part of this settlement. The two settlements resolve all pending litigation over the Fallout intellectual property owned by Bethesda.
Robert Altman, Chairman and CEO of ZeniMax, expressed satisfaction on behalf of the Company with the resolution of the two lawsuits saying, “While we strongly believe in the merits of our suits, we are pleased to avoid the distraction and expense of litigation while completely resolving all claims to the Fallout IP. Fallout is an important property of ZeniMax and we are now able to develop future Fallout titles for our fans without third party involvement or the overhang of others’ legal claims.”
Following the purchase of the property, Bethesda Game Studios, the 2011 ‘Studio of the Year’ and the development team behind the 2011 ‘Game of the Year’, The Elder Scrolls® V: Skyrim™, developed Fallout® 3. ZeniMax Media’s publishing subsidiary, Bethesda Softworks, published Fallout® 3, a highly acclaimed sequel which won ‘Game of the Year’ honors in 2008, for Xbox 360® video game and entertainment system from Microsoft, PlayStation®3 computer entertainment system, and Games for Windows. Bethesda also published the popular title, Fallout: New Vegas®, in 2010 for the same platforms. Fallout: New Vegas® Ultimate Edition, which will include the original game and the award-winning downloadable content in one special package, is planned for release by Bethesda in early 2012.
